Terms of Service

1. Your agreement with socialz
These Terms of Service (the “Terms”) form a binding agreement between you and socialz (“socialz,” “we,” or “us”) governing your access to and use of our website at socialz.org and any related services (collectively, the “Service”). By creating an account, submitting a profile, contacting a creator, or otherwise using the Service, you accept these Terms. If you do not agree, do not use the Service.
2. Eligibility and accounts
You must be at least 18 years old and able to form a legally binding contract in your jurisdiction to use the Service. You are responsible for the accuracy of the information you provide and for safeguarding your account credentials. You agree to notify us promptly of any unauthorized access. We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose risk to other users.
3. Business and Creator roles
At sign-up you choose a role: Business (you are looking to be matched with a Social Media Manager or UGC Creator) or Creator (you offer those services). Each role unlocks different surfaces on the Service. You are responsible for the truthfulness of the information you submit in either role, including your portfolio, headline, location, work model, budget, niches, standout metrics, and any reviews you author.
4. Acceptable use
You agree not to use the Service to:
- violate any applicable law or third party right;
- post content that is unlawful, defamatory, harassing, sexually explicit, hateful, or that infringes intellectual property;
- impersonate another person or misrepresent your affiliation with anyone;
- attempt to circumvent our matching, contact, or review mechanisms, including by creating fraudulent reviews or fake conversion signals;
- scrape, crawl, or harvest data from the Service except via APIs we explicitly authorize;
- upload malware, exploit security vulnerabilities, or interfere with the operation of the Service or its underlying infrastructure.
5. Your content
You retain ownership of the text, images, links, reviews, messages, and other content you submit (“User Content”). You grant socialz a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute your User Content for the purpose of operating, providing, and improving the Service, including surfacing your profile to potential matches, showing portfolios on the Service, and sending transactional notifications. You represent that you have all rights necessary to grant that license and that your User Content does not infringe any third party right.
Reviews submitted on the Service must reflect a genuine interaction. We may remove reviews that we reasonably believe to be fraudulent, retaliatory, or in violation of these Terms.
6. Marketplace mechanics
socialz is a matching surface. We curate a short list of Creators for each Business based on hard constraints (budget, location, work model) and soft constraints (niche, style, verified trust). We are not a party to any agreement, engagement, or contract that you enter into with another user. We do not employ Creators, do not act as an agent or representative of any user, and do not guarantee the suitability, quality, legality, or outcome of any engagement arranged through the Service.
Contacting a Creator through the Service creates a record of that contact. If a Business subsequently leaves a Review, that Review is tied to the underlying contact as a verification signal that informs our ranking. You are responsible for negotiating, documenting, performing, paying for, and resolving disputes about any work that results, directly with the other user and outside the Service.
7. Fees
Use of the Service is currently offered without charge. We reserve the right to introduce paid features, subscription tiers, or transaction fees in the future, with notice and an opportunity to decline before any charge is incurred.
8. Intellectual property
The Service, including its design, code, brand, copy, and curated taxonomies (niches, styles, budget tiers, and the matching algorithm), is owned by socialz and protected by intellectual property laws. Except as expressly permitted in these Terms, you may not copy, modify, distribute, sell, or create derivative works of any part of the Service.
9. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted, error-free, or that any match, review, or profile information is accurate or reliable. Your use of the Service is at your own risk.
10. Limitation of liability
To the maximum extent permitted by law, socialz and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, business opportunities, or goodwill, arising out of or related to your use of the Service. Our aggregate liability for any claim arising out of or related to the Service is limited to the greater of (a) the amount you paid us in the twelve months before the claim and (b) one hundred U.S. dollars (US$100).
11. Indemnification
You agree to indemnify and hold harmless socialz from any claim, demand, loss, or liability (including reasonable legal fees) arising out of your User Content, your use of the Service, your violation of these Terms, or your violation of any third party right.
12. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access at any time, with or without cause and with or without notice, including for violation of these Terms. Provisions that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnity, and governing law) will survive.
13. Changes to these terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page and, for material changes, give reasonable additional notice (for example, by email or an in-product notice). Your continued use of the Service after a change becomes effective constitutes acceptance of the updated Terms.
14. Governing law
These Terms are governed by the laws of the jurisdiction in which socialz is established, without regard to its conflict-of-laws principles. Exclusive jurisdiction and venue for any dispute will lie in the competent courts of that jurisdiction, unless applicable consumer protection law gives you a non-waivable right to bring the dispute in your home jurisdiction.
